LGBT Lawyer in South Florida Leads the Fight for Equal Rights

 

The Supreme Court recently handed down the landmark decision to legalize gay marriage in all fifty states. But long before this historic ruling, Coral Springs divorce lawyer Nancy Brodzki has been on the front lines in the fight for marriage equality in Florida. Last December, Brodzki successfully represented Heather Brassner who was granted a divorce from her partner Megan Lade. It marked the first time a gay divorce was granted in Florida, and the third trial judge to declare the State’s ban on same sex marriage (including recognizing same sex marriages or civil unions for purposes of granting a divorce) unconstitutional. The case was one of dozens around the nation which has helped lead to the historic decision of the United States Supreme Court in Obergefell vs. Hodges on June 26, 2015.

Throughout the course of American history, we have seen that social change doesn’t happen overnight. It was only 106 years ago when women were finally awarded the right to vote through the ratification of the 19th Amendment. The 1954 Brown vs. Board of Education decision by the Supreme Court ruled the segregation of public schools as unconstitutional, and in 1967 Loving vs. Virginia the Court overturned bans against interracial marriage. Until Lawrence vs. Texas in 2003, sexual conduct between same sex adults was criminal in many states, and gays and lesbians were forced to live in the shadows, keeping their relationships a secret. Even former President Bill Clinton’s “Don’t ask, don’t tell” policy in 1993 for members of the American military was just a small step in the right direction. But it was hardly a victory for LGBT equality.

It may seem ironic that a divorce case would help bring in the change of marriage laws in Florida and ultimately throughout the United States.
